Can a lender still collect on a very old personal loan?

Short answer

After the statute of limitations expires (3-10 years depending on state), lenders cannot sue to enforce the debt through courts. However, the debt still legally exists, can still be sold to collectors, and may still appear on your credit report for up to 7 years from the original delinquency date.

What the statute of limitations means: Each state sets a time limit for creditors to file lawsuits to collect unpaid debts. Once this period expires, the debt becomes 'time-barred' - the creditor loses the right to sue. This does not mean the debt disappears; it means the most powerful collection tool (court judgment) is no longer available.

Credit report timeline is separate: The 7-year credit reporting period runs from the original delinquency date - independent of the statute of limitations. Even if a debt is time-barred from collection, it may still appear on your credit report.

Suing on a time-barred debt: Some collectors sue anyway, hoping the debtor does not appear in court to raise the statute of limitations defense. If sued on an old debt, you must show up and assert the defense - it is not automatic.
